Terms and conditions of purchase

1. GENERAL PROVISIONS

1.1 These Terms and Conditions of Purchase and Sale of Services (hereinafter referred to as the „Terms and Conditions“) set out the general terms and conditions for the purchase of services on the electronic Kabinam.lt website at www.kabinam.lt (hereinafter referred to as „kabinam.lt“).

1.2. The website is controlled and services are sold by Kiriro, MB, company code 307548550, registered address Gerosios Vilties g. 5A-104, LT-03147 Vilnius (the "Seller"). Kiriro, MB, company code 307548550, address Gerosios Vilties g. 5A-104, LT-03147 Vilnius („Seller“).

1.3 The Buyer is the person who purchases goods from kabinam.lt. The right to purchase goods on kabinam.lt is vested in natural persons of legal age and legal persons acting through their authorised representatives.

1.4 By registering or placing an order, the Buyer unconditionally confirms that he/she meets the conditions set out in Clause 1.3 and is entitled to make purchases in the kabinam.lt shop.

1.5 Personal Data - the personal data of the Buyer, which the Buyer voluntarily provides when registering and/or ordering goods in the kabinam.lt shop. Personal data shall also be considered as the history of goods purchased by the Buyer, where such data is stored in accordance with the requirements of the legislation of the Republic of Lithuania. If the recipient of the goods is a person other than the Buyer, the Buyer must ensure that the personal data of the recipient is provided lawfully.

1.6 "Terms and Conditions" means the terms and conditions of purchase of this e-shop www.kabinam.lt. These Rules for Purchase in the Online Shop set out the rights, obligations and responsibilities between the Buyer purchasing goods on www.kabinam.lt and the Seller when purchasing goods in the Online Shop.

1.7 The Seller reserves the right to change, amend or supplement the Rules at any time in accordance with the statutory requirements. When the Buyer shops in the kabinam.lt online shop, the Terms and Conditions in force at the time of placing the order shall apply, and the Buyer is therefore advised to familiarise himself with the Terms and Conditions each time he shops.

1.8 The Customer shall not be able to place an order for goods in the kabinam.lt online shop if he/she is not familiar with the Terms and Conditions or does not agree with them. The Seller shall not assume any responsibility or risk if the Buyer has not read the Terms and Conditions in part or in full, although he has been given the opportunity to do so.

1.9.The Seller confirms that it is responsible for the sale of the goods ordered in the Kabinam.lt online shop and for the proper delivery of the purchased goods, the quality of the goods, the proper fulfilment of the conditions for return, and the exercise of other rights and obligations of the Seller provided for by law.

1.10. The Seller has the right to restrict the use of the services of the Kabinam.lt Shop by the Buyer or cancel the Buyer's registration without notice if the Buyer uses the Kabinam.lt Shop in violation of these Terms and Conditions, attempts to undermine the stability and/or security of the orders, operation of Kabinam.lt Shop.

2. REGISTRATION AND PROCESSING OF PERSONAL DATA

2.1. To order goods in the kabinam.lt online shop, the Buyer may:

2.1.1. by registering in this electronic shop kabinam,lt - by entering the data requested in the registration;

2.1.2. without registering on this e-shop.

2.2 When ordering goods in the manner provided for in Clause 2.1 of the Rules, the Buyer shall indicate in the relevant information fields provided by the Seller the personal data of the Buyer (or the recipient of the goods) necessary for the proper execution of the order: name, surname, delivery address, telephone number and e-mail address.

2.3 By accepting these Terms and Conditions, the Buyer consents to the processing of the Buyer's personal data as set out in clause 2.2 for the purposes of the purchase and delivery of the Goods to the Buyer and for bookkeeping purposes. The data of the recipient of the goods will be provided to the person who delivers the goods for the sole purpose of fulfilling the contract with the Buyer. 2.4 The Buyer shall have the right to change, amend or cancel his/her registration at any time without restriction.

2.5 When registering, the Buyer shall create individual login details (username and password) and shall keep them confidential and not disclose them to any third party. In order to reduce the risk of unauthorised access to the kabinam.lt Shop on behalf of the Buyer, it is recommended to create a complex, unpredictable password (it is recommended that the password consists of at least 8 characters, using upper and lower case letters, numbers and punctuation marks, avoiding easily predictable words (Buyer's name, surname, etc.) and/or numbers (e.g. date of birth), etc.) and change it at least once every 6 (six) months. The Buyer is responsible for the complexity of the login data he/she has created and for its storage, as well as for any actions (data transfer, orders placed, user comments, etc.) that are carried out in the kabinam.lt shop under the Buyer's individual login name and password. If the services provided by kabinam.lt are used by a third party who has logged into the online shop using the Customer's login details, the Seller shall consider this person as the Customer. If the Buyer loses his/her login details, he/she must immediately inform the Seller by post, telephone or e-mail or change his/her login details by logging in to the kabinam.lt shop system. The Seller cannot and will not be held liable for any damage caused to the Buyer by third parties using the Buyer's login details when accessing the kabinam.lt shop. The security of the login data is of particular importance in the case of payments by debit or credit cards.
Refusing a contract for the sale of a quality product, the direct costs of returning the goods shall be borne by the Buyer. Goods are returned to: Gerosios Vilties g. 5A-104, LT-03147 Vilnius.

2.6 The Buyer's personal data will be processed in accordance with Privacy Policy. If the Customer uses the services of the kabinam.lt shop, the Customer shall be deemed to have consented to the processing of the Customer's personal data and to have confirmed that all the information and personal data provided is true and correct.

2.7 In addition, whether or not the Buyer registers an account, the Buyer may provide an email address for the Seller to send the Buyer newsletters or other product offers. The Buyer may withdraw this consent at any time by clicking on the link provided in the newsletter or by informing the Seller directly by e-mail (more Privacy Policy).

3. PRICES, PAYMENT PROCEDURES AND TERMS

3.1 The prices of the goods in the kabinam.lt shop and in the order are in Euros including VAT. The Goods shall be sold to the Buyer at the prices valid in the kabinam.lt shop at the time of placing the order.

3.2 The Buyer may pay for the Goods in one of the following ways:

3.2.1. payment by electronic banking means prepayment through the electronic banking system used by the Buyer. In order to use this form of payment, the Buyer must have signed an e-banking agreement with the bank. The Buyer shall transfer the money to the e-shop's current account. When using this method of payment, the payment order must be confirmed no later than 3 (three) hours after the order has been placed with the Seller and the payment order has been generated. The payment shall be deemed to have been executed when the Bank confirms to the Merchant that the payment order has been successfully executed. In this case, the responsibility for the security of the data during the Buyer's payment rests with the respective bank, as all monetary transactions take place in the bank's electronic banking system.

3.2.2. payment by bank transfer - this is a prepayment, where the Buyer transfers the money to the Seller) days from the moment of placing the order in the Online Shop. 3.3 The Buyer undertakes to pay for the Goods immediately. Only upon receipt of payment for the Goods shall the parcel of Goods be formed and the delivery period commence.

4. ORDERING AND DELIVERY

4.1 The Buyer may make purchases in the Online Shop 24 hours a day, 7 days a week.

4.2 For delivery of goods by courier or parcel services, the rates applicable at the time of ordering the goods shall apply, as set out in the Online Shop. The delivery price shall apply to the entire basket of goods ordered and shall not be subdivided for individual items.

4.3 The Buyer may choose one of the following methods of delivery: to receive the ordered goods by post, by courier to the address specified by the Buyer or to collect them from parcel offices. If the order is paid for by 12 noon on a working day, the goods shall be dispatched to the Buyer within 3(three) working days. If the order is paid for on a working day after 12 noon or on a non-working day, the order shall be dispatched to the Buyer within 3(three)-4(four) working days. The exact time of delivery shall be agreed between the Courier and the Buyer by telephone, by the Courier calling the number provided by the Buyer or by SMS notification of delivery to the delivery point.

4.4 Goods ordered by the Buyer shall be delivered to the address specified at the time of the Order. If the Buyer chooses delivery by courier, the Buyer undertakes to specify the exact delivery address in the Buyer's online purchase account and to collect the goods at the delivery time agreed with the courier. The Buyer shall ensure that the Buyer or another person to whom the Buyer has given the order number picks up the goods at the delivery location provided at the time of the order, at the time agreed with the courier. The Buyer shall be liable and shall not be entitled to claim against the Seller for delivery of the goods to the wrong person by disclosing the order number to another person. If the delivery of the goods is not possible due to the fault of the Seller (e.g. the Buyer has given an incorrect address when ordering the goods, the Buyer or the recipient cannot be found at the given address, etc.) or the Buyer does not collect the goods at the agreed time with the courier, the Seller may terminate the contract of purchase and sale of the goods without prior notice. If the Seller terminates the contract of sale and purchase in the case provided for in this clause, the Seller shall reimburse to the Buyer within 14 days the amount paid for the goods, deducting the Seller's costs of delivery from that amount.

4.5 The Seller shall deliver the Goods to the Buyer in accordance with the terms specified in the descriptions of the Goods. These time limits are provisional and do not apply in cases where the Seller does not have the goods in stock and the Buyer is informed of a shortage of the goods ordered. The Buyer also agrees that in exceptional cases the delivery of the goods may be delayed due to unforeseen circumstances beyond the Seller's control. In such case, the Seller undertakes to contact the Buyer immediately to agree on the terms of delivery.

4.6 In all cases, the Seller shall be exempt from liability for breach of the time limit for delivery of the Goods if the Goods are not delivered to the Buyer or are not delivered on time due to the fault of the Buyer or due to circumstances beyond the Seller's control.

4.7 The Buyer shall in all cases immediately inform the Seller if the consignment is delivered in broken or otherwise damaged packaging, if the consignment contains unordered goods or the wrong quantity of goods, or if the consignment is incomplete.

4.8 The Buyer, upon acceptance of the purchased goods, must inspect the condition of the packaging, quantity, quality and range of the goods before signing the delivery documents. If the Buyer notices any defects in the goods or discrepancies between the consignment and the order, the Buyer shall not accept the consignment and shall, together with the courier, fill in a special consignment inspection report, in which the Buyer shall indicate the irregularities found and inform the Seller thereof at the telephone number or e-mail address specified in these Rules. If the Buyer confirms the delivery documents without any comments, it shall be deemed that the goods have been delivered to the Buyer in an undamaged consignment package, and the quantity, quality and assortment of the goods are in accordance with the order and the terms and conditions of the contract of sale and purchase.

5. GUARANTEE OF THE QUALITY OF THE GOODS AND PERIOD OF FITNESS FOR USE

5.1. . The details of the goods sold in the online shop are set out in the description of the goods for each item.

5.2 The Seller shall not be liable for the fact that the colour, shape or other parameters of the goods in the online shop may not correspond to the actual size, shape and colour of the goods due to the characteristics of the display used by the Buyer.

5.3 If the Goods are faulty on delivery to the Buyer, the Seller undertakes to take back such Goods and replace them with similar suitable Goods or refund the money paid for the faulty Goods. The defects of the goods sold shall be eliminated, the defective goods shall be replaced and returned in accordance with the Retail Trade Rules approved by the Government of the Republic of Lithuania by its Resolution No. 697 of 11 June 2001 (new wording as of 01.09.2019) and the Civil Code of the Republic of Lithuania.

6. WITHDRAWAL FROM THE CONTRACT. EXCHANGE AND RETURN OF GOODS

6.1 The Buyer shall have the right to withdraw from the contract of sale of goods concluded in the electronic shop kabinam.lt by notifying kabinam.lt in writing no later than 14 (fourteen) calendar days from the date of delivery of the goods by contacting the e-mail address info@kabinam.lt.

6.2 Upon written notice of withdrawal, the Buyer must return the Goods (if delivered) within 5 (five) calendar days at the latest.

6.3 Pursuant to Article 6.228-10 of the Civil Code of the Republic of Lithuania, the Buyer shall not be entitled to return quality goods which have been used by the Buyer, damaged, unpacked, broken packaging or other actions taken by the Buyer which have caused the goods to lose their merchandiseable appearance due to reasons of health or hygiene, as well as goods produced according to the Buyer's special instructions, which are not pre-manufactured and which are produced according to the Buyer's personal choice or instruction, or goods that are clearly tailored to the Buyer's personal needs;

6.4.The Goods shall be deemed to be defective if the expiry date of the Goods has expired, the Goods contain ingredients prohibited by law, the consistency or other essential characteristics of the Goods have been altered due to inadequate storage conditions prior to the transfer of the Goods to the Buyer, the Goods are mechanically damaged, their packaging is damaged or there are any other defects in the quality of the Goods.

6.5 Goods returned or exchanged must be of good quality, intact, unpacked, in good condition (labels removed and intact, protective films peeled off, etc.) and unused. The goods must be returned in their original packaging, in the same condition as when received by the Customer, together with the document of purchase, the instructions for use and other accessories.

6.6. Returns shall be delivered to: Kiriro, MB, Gerosios Vilties g. 5A-104, LT-03147 Vilnius, Lithuania. Kiriro, MB, Gerosios Vilties g. 5A-104, LT-03147 Vilnius. The customer pays for the shipping service. Detailed return instructions will be provided to the customer at info@kabinam.lt.

6.7 Money paid for goods accepted by the Buyer but subsequently rejected shall be paid into the Buyer's account no later than 14 (fourteen) days after the return of the goods. In the event of a return or exchange of goods of good quality and conforming to the Buyer's order, the Buyer shall be refunded the delivery charge in proportion to the quantity of goods returned.

6.8 If you bought the product in a physical shop, you should contact the shop where you bought the product for a refund. Please make sure you have the receipt with the product. If you do not have a receipt, in exceptional circumstances we may be able to exchange the item for another one, but we will not be able to refund you.

7. FINAL PROVISIONS

7.1 These Terms and Conditions are made in accordance with the legislation of the Republic of Lithuania.

7.2 The law of the Republic of Lithuania shall apply to relations arising under these Terms and Conditions.

7.3 In the event of damage, the party at fault shall indemnify the other party for direct damages in accordance with the procedure and on the grounds established by the laws of the Republic of Lithuania.

7.4 All disputes arising out of the application of these Terms and Conditions shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.

7.5 Every user has the possibility to resolve any disputes with kabinam.lt electronically, without going to court. First of all, the consumer must contact kabinam.lt in writing and within 14 days from the receipt of the complaint, if kabinam.lt does not respond to the consumer's complaint or if the consumer's complaint is not satisfied, the consumer may apply to the entity dealing with consumer disputes out of court, namely the State Consumer Rights Protection Service (Vilniaus g. 25, 01402 Vilnius, e-mail: tarnyba@vvtat.lt, tel. 852626751, website www.vvtat.lt), or to its territorial units in the districts, or by filling in the application form on the EGS platform http://ec.europa.eu/).
